Zela Jet Terms & Conditions 2023
- The client understands that items not included in the Charter Price, are at the discretion of the operator and not ZELA JET . The client accepts that these items may be expensive. For example, anti-icing and/or de-icing may have a cost of EUR 2.000. By signing this booking request, The client acknowledges this and agree to pay if anti-icing and/or de-icing is required. The client agrees to pay any such sums in full to either ZELA JET or the operator (as applicable) within the timeframe stipulated irrespective of the amount due. The client agrees that any invoice relating to the Flight(s) shall be paid without dispute to ZELA JET on demand notwithstanding any delay. The client agrees to pay any damage that may occur in the interior of the aircraft due to the presence of pets on board.
- The carriage of lithium ion/metal batteries is not permitted in either hand baggage or baggage stowed in the hold, and we know that this shall include hoverboards, (sometimes known as solowheels or airwheels) and the Galaxy Note 7 mobile telephones or any other mobile phones or electronic devices which are the subject to product recalls or known faults. The carriage of such items is prohibited in both hand baggage and checked baggage. We shall ensure that all passengers are made aware of this prohibition. In the event a claim for damage or a loss occurs as a result of lithium ion/metal batteries contained in hand baggage, checked baggage or otherwise by us or and/or our passengers, The client will defend and indemnify ZELA JET from any claims whatsoever arising from such damage or loss including the payment of all costs and reasonable attorneys’ fees. ZELA JET ’s right to a defense is separate and apart from its right to indemnity
- Cancellation Policy
In addition, The client accepts that the following cancellation terms (or those of the operator, whichever are the higher) will apply and which we shall pay to ZELA JET upon demand:
- 50% of the total amount in the case of cancellation after signing Charter Confirmation till 8 days prior to the flight.
- 60% of the total amount in the case of cancellation from 7 days till 48h before departure time.
- 80% of the total amount in the case of cancellation within 48 hours before departure time.
- 100% of the total amount in the case of cancellation within 24 hours before the departure time.
- The client shall ensure that all passengers shall hold the necessary travel documents (including but not limited to passports, visas, health and other certificates) for departure from the country of origin, transit through any intermediate points and entry into the country of destination of the Flight(s) and The client shall indemnify ZELA JET against any losses ZELA JET may suffer if any passenger fails to hold any necessary travel document.
- The client shall be solely responsible for ensuring that all passengers arrive at the departure airport ready for boarding no later than the time advised prior to the scheduled departure time, or any specific time communicated by ZELA JET . At the discretion of the operator, any Flight(s) may be terminated if all passengers have not boarded by the scheduled departure time. If the Flight(s) is terminated by the operator under the terms of this paragraph The client shall be charged the Cancellation Fee of 100% and any additional cost of the operator. If the operator, in its absolute discretion agrees to wait for any late passenger, The client understands and agrees that operator may charge additional costs for any additional wait time and The client agree to pay such additional costs upon receipt of invoice.
- The client accepts that the option of any additional wait time is not guaranteed and is at the operator’s absolute discretion. Otherwise, the Flight(s) are to be operated subject to the relevant operator’s Standard Terms and Conditions and/or tariffs currently in force, which please sign on my/our behalf, (or on behalf of the company or corporation for which I am acting) as my/our agent.
- The client accepts that ZELA JET has no responsibility for the performance or otherwise of the Flight(s) and that all liability in respect of the performance or otherwise of the Flight(s) falls upon the operator; The client shall hold ZELA JET harmless and defend and indemnify ZELA JET against any claim brought against ZELA JET by the operator or any third party caused by any act or omission on my/our part or that of any of my/our passengers, associated parties or subcontractors. ZELA JET ’s right to a defense is separate and apart from its right to indemnity. For the avoidance of doubt, The client accepts that any issues caused by or related to the Coronavirus Disease 2019 (COVID-19) shall not be an event of force majeure unless the Carrier confirms in writing that they are unable to operate the charter flight.
- The client accepts that ZELA JET may terminate this Agreement immediately if the operator fails to send to ZELA JET any requested documents related to the operation of the Flight(s). In the event that any agreement between the operator and ZELA JET is terminated for whatever reason, ZELA JET shall refund to Me/Us such part of the Charter Price previously paid by Me/Us as relates to the affected flight(s), minus any costs incurred by ZELA JET or the operator.
- This booking request may be executed by (i) any individual or entity entering into this booking request as principal (“Principal”); (ii) an end customer (“End Customer”); or (iii) any individual or entity acting on behalf of an End Customer or Principal (“Agent”) (hereinafter collectively referred to as the “Parties”). Where any of the Parties executes this booking request or otherwise makes payment or accepts an invoice from ZELA JET ,the applicable Parties hereinafter agree to be held jointly and severally liable for any breach of this booking request whether in contract or tort including any acts or omissions on behalf of any passenger utilizing the Flight(s) services.
- Each provision of this booking request is severable and distinct from the others and if any provision, or paragraph of one provision, is or at any time becomes to any extent or in any circumstances invalid, illegal or unenforceable for any reason, it shall to that extent or in those circumstances, be deemed not to form part of this booking request but the validity, legality and enforceability of that and all other provisions, or other paragraphs of such provision, of this Agreement shall not be affected or impaired, it being the parties intention that every provision of this booking request shall be and remain valid and enforceable to the fullest extent permitted by law.
- The client accepts that all contact with the operator should be through ZELA JET as our agent and The client shall not contact the operator either directly or indirectly in relation to any matter pertaining to this Flight(s) or for the procurement of any future air charter services to be provided by the operator for a period of 12 months from the date f this Flight(s) except as provided for in the Agreement booking request or with the prior written consent of ZELA JET.
- The client accepts that ZELA JET shall not be liable for any additional charges incurred in relation to any delay, deviation, cancellation or any other change in relation to the Flight as a result of any decision, outcome or policy pursuant to any decision regarding ‘Brexit’ or any decision based on the United Kingdom leaving the European Union. The client shall indemnify ZELA JET against any loss, damage, liabilities costs or expenses of whatsoever nature caused to suffered or incurred by ZELA JET and its officers or employees arising out of any decision, outcome or policy of Brexit or the United Kingdom leaving the European Union.
- The client warrants that there shall be no sanctioned individuals on the Flight. Further, I/W warrant that The client shall not act (or fail to act) in a way which could cause a potential infringement of any applicable sanctions, and The client shall indemnify ZELA JET against any loss, damage, liabilities costs or expenses of whatsoever nature caused to be suffered or incurred by ZELA JET and its officers, employees agents or subcontractors in relation to applicable sanctions.
- The client agrees that no action shall be entertained by ZELA JET unless a written notice providing the details of the claim is presented to ZELA JET . Such written notice is required within fourteen (14) days from the date of the Flight. Should The client not comply with the foregoing, The client hereby waives any right to damages and ZELA JET shall be fully waived and released.
- This booking request and any disputes or claims arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and interpreted in accordance with English law and the parties hereby agree and submit to the jurisdiction of the English courts.
- The client recognizes that ZELA JET will receive personal data for the purposes of providing services, facilitating immigration and entry procedures, and ZELA JET will be required to make available such data to the operator, government agencies and other parties who require it in connection with the services being provided by ZELA JET .
- For these purposes, The client authorises ZELA JET to retain and use personal data and transmit internationally to the operator, ZELA JET ’s offices, authorised agents, government agencies, other carriers or other third parties when required. Further, The client acknowledges and gives consent to be contacted via post, email or telephone by ZELA JET in the future in relation to the provision of any product and services
